Cittadellarte – Fondazione Pistoletto ONLUS takes extreme care in protecting the personal data of the users of this website, and is committed to handling them in compliance with the relevant legislation (in particular the EU General Data Protection Regulation 2016/679, hereafter referred to as “GDPR”).

The present document (“Privacy Policy”) provides information on the handling of personal data collected by Fondazione Pistoletto ONLUS through the website (“Website”) and is therefore to be intended as a notice for the benefit of the interested parties in accordance with art. 13 of the GDPR.

The Website’s sections in which users’ personal data are collected for determined purposes normally include specific privacy statements that this Privacy Policy complements.

This Privacy Policy only applies to Cittadellarte – Fondazione Pistoletto ONLUS’s website, and not to websites users might access through links on the Website itself.

Data Controller

The Data Controller is Cittadellarte – Fondazione Pistoletto ONLUS, with offices in via Serralunga 27, 13900 Biella (Italy).

Types of data handled and handling purposes

The handling of personal data of users visiting the Website without sending communications or using any of the available services/functions is limited to browsing data, i.e. those necessary for the functioning of the computer systems in place to manage the Website and the internet communication protocols, e.g. the IP address and the domain of the device used to visit the Website, and other parameters of the operating system used by the user to connect to the Website. Cittadellarte – Fondazione Pistoletto ONLUS collects these and other technical data (e.g. the number of visits to the Website) only for statistical purposes and in anonymous form, in order to monitor the functioning of the Website and improve its functionality. These data are not collected in view of being associated with other information so as to identify users, but the nature of these data might allow the identification of users through elaborations and associations with data stored by third parties. Data voluntarily provided by users

Optional, explicit and voluntary sending of email to the addresses published on the Website entails the acquisition of the email address of the user/sender, necessary to reply to requests, and of other personal data possibly included in the email.

Cittadellarte – Fondazione Pistoletto can handle users’ personal data for these purposes:

  • to manage requests and communications received through the Website itself (dedicated forms) or through email voluntarily sent by users to Cittadellarte – Fondazione Pistoletto ONLUS’s addresses published on the Website, also in connection to applications to projects ascribable to Cittadellarte – Fondazione Pistoletto ONLUS;
  • to manage the registration to activities like open calls, events, programmes, scholarships and similar;
  • to carry out institutional communication and/or send promotional material by Cittadellarte – Fondazione Pistoletto ONLUS or its partners, via electronic or traditional mail;
  • to meet the obligations deriving from laws, policies and the European Union legislation.

As far as the purposes listed in the first two points are concerned, data handling can be done without the user’s consent, as indicated in art. 6.1 section B of the GDPR, as the handling is necessary for the execution of pre-contractual measures (requests for info, communications) on the user’s explicit request; should the necessary personal data (fields marked with an asterisk) not be provided, we will not be able to deal with the user’s request/communication.

As far as the purposes listed in the third point are concerned, data handling can only be done with the user’s explicit consent, as indicated in art. 6.1 section A of the GDPR.

As far as the purposes listed in the fourth point are concerned, legal basis for the handling is provided by art. 6.1 section C of the GDPR.

All users’ data are also handled with paper and automated instruments suitable to guarantee security and confidentiality.

All the data voluntarily provided by users are handled for the above-mentioned sole purposes they have been provided for.
Relevant synthetic information is published on the Website’s pages designed for specific services and/or projects.

The Website might contain links to other websites (third parties’ websites). Cittadellarte – Fondazione Pistoletto ONLUS does not access or inspect cookies, web beacons and other user-tracking techniques used by third parties’ websites accessible from the Website; and does not check contents and materials published by or obtained through third parties’ websites, nor their policies in handling users’ personal data; and explicitly declines any responsibility for third parties’ websites’ handling of personal data. The present Privacy Policy only applies to the Website this document refers to.

Nature of data provision

The provision of personal data is optional. However, users wanting to register on the Website and/or participate in Cittadellarte – Fondazione Pistoletto ONLUS’s projects and/or receive information about Cittadellarte – Fondazione Pistoletto ONLUS’s activities must fill in all the obligatory fields in the relevant forms and, where requested, express their consent to the handling of their data. Refusal to provide their consent will result in not being able to register on the Website, to participate in Cittadellarte – Fondazione Pistoletto ONLUS’s projects, to receive information about Cittadellarte – Fondazione Pistoletto ONLUS’s activities the user might be interested in, to receive general information about Cittadellarte – Fondazione Pistoletto ONLUS and its partners. Users can modify or revoke their consent at any time, i.e. refuse data handling, writing to the Data Controller.

Modalities of data handling

Personal data will be handled by Cittadellarte – Fondazione Pistoletto ONLUS through suitable automated, computer and telematic instruments, or through manual and paper processing, according to logics strictly linked to the above-mentioned purposes they have been provided for, and always following procedures guaranteeing their security and confidentiality. Personal data will be handled by Cittadellarte – Fondazione Pistoletto ONLUS’s staff specifically authorised to handle them in the context of their work duties, and – if necessary or instrumental for the above-mentioned purposes – by third parties acting on behalf of Cittadellarte – Fondazione Pistoletto ONLUS, depending on the circumstances, as autonomous or co-controller, or nominated as responsible for data handling in accordance with art. 28 of the GDPR (partners in Fondazione Pistoletto’s projects, service providers, delivery companies, shipping agents, IT technicians, other suppliers Cittadellarte – Fondazione Pistoletto ONLUS might rely on for the above-mentioned purposes).

All the subjects collecting data will only receive the necessary data to carry out their duties and are committed to using them only for the above-mentioned purposes and to handling them in respect of the relevant legislation. With the exception of what previously stated, data will not be shared with third parties, physical or juridical persons not working for the Data Controller in a commercial, professional or technical role, and will not be made public.

In regard to the possible communication of data to other countries, which include countries that might not guarantee the same level of data protection requested by the GDPR (i.e. extra-CEE countries), the Data Controller assures that the handling will be carried out – depending on the circumstances – in accordance with one or more modalities indicated in the GDPR, like the explicit consent of the user, the adoption of standard contractual clauses approved by the European Commission, the selection of subjects adhering to international programmes for free data circulation (e.g. EU-USA Privacy Shield) or operating in countries considered secure by the European Commission.

Duration of the conservation of the data

In compliance with art. 5.1 section C of the GDPR, information systems and computer programmes used by Cittadellarte – Fondazione Pistoletto ONLUS are configured so as to reduce to the minimum the use of personal and identification data; these data are handled only as much as necessary to pursue the purposes mentioned in the present Policy; these data will be stored for the necessary duration to serve the purposes actually pursued and always within the terms imposed by the relevant legislation, and on the principles of reducing the handling and the duration of conservation to the minimum possible, and of a sensible management of the archives.

Rights of the interested parties

The user can exercise the rights granted by art. 15-22 of the GDPR at any time, including the right to obtain confirmation of the existence (or absence) of personal data concerning them, to verify their content, origin, accuracy and location (also with possible reference to other countries), to ask for a copy, to request an amendment and, in cases indicated in the relevant current regulations, to demand that their data handling be limited, cancelled or refused for direct contact activities (also with reference to specific means of communication). The user will also always be able to withdraw their consent and/or make observations on particular uses of data in regard to personal situations not considered to be correct or justified by the current rapport, or to complain about a controlling authority to the Guarantor for the Protection of Personal Data.
